Who Pays in a Car Accident When the At-Fault Driver Is Uninsured in Oklahoma?

March 24, 2025
Bison Law Firm

Getting into a car accident is stressful enough, but when the at-fault driver doesn’t have insurance, it can create even more uncertainty. Who pays for your medical bills and vehicle repairs? How can you recover compensation? At Bison Law Firm, we help car accident victims in Oklahoma navigate these tough situations and fight for the compensation they deserve.

Oklahoma’s Insurance Requirements

Oklahoma law requires all drivers to carry minimum liability insurance to cover damages if they cause an accident. The state’s minimum coverage requirements are:

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury (if multiple people are injured)
  • $25,000 for property damage

Despite these requirements, Oklahoma has one of the highest rates of uninsured drivers in the country, with an estimated 1 in 4 drivers uninsured. If you’re hit by one of these drivers, you may need to rely on your own insurance or other legal options to recover damages.

How Can You Recover Compensation?
1. Uninsured Motorist (UM) Coverage

Uninsured motorist (UM) coverage is designed for exactly this situation. If you have UM coverage as part of your policy, your insurance will cover your medical expenses, lost wages, and other damages up to your policy limits. Oklahoma law requires insurance companies to offer UM coverage, but you can decline it in writing. If you’re unsure whether you have UM coverage, check your policy or contact your insurer.

2. Personal Injury Protection (PIP) or MedPay

Some drivers in Oklahoma carry Medical Payments (MedPay) coverage, which helps cover medical bills regardless of who was at fault. While Oklahoma does not require these coverages, they can be helpful in an uninsured driver accident.

3. Collision Coverage for Vehicle Repairs

If your vehicle is damaged in an accident caused by an uninsured driver, collision coverage (if included in your policy) can help cover repair costs. Unlike liability insurance, collision coverage applies regardless of fault, but you’ll likely need to pay your deductible before your insurer covers the rest.

4. Filing a Lawsuit Against the At-Fault Driver

Another option is suing the at-fault driver directly. However, this is often not a reliable way to recover compensation—many uninsured drivers have little to no assets, which is why they don’t carry insurance in the first place. Even if you win a judgment against them, collecting the money may be difficult.

What to Do After an Accident with an Uninsured Driver

If you’re in an accident with an uninsured driver in Oklahoma, take these steps to protect your rights and improve your chances of recovering compensation:

  1. Call the Police – A police report is essential, especially when the other driver is uninsured.
  2. Gather Evidence – Take photos of the accident scene, vehicle damage, and any visible injuries.
  3. Exchange Information – Get the other driver’s name, contact details, and vehicle information.
  4. Seek Medical Attention – Some injuries take time to appear, so don’t delay medical treatment.
  5. Notify Your Insurance Company – Report the accident as soon as possible to begin the claims process.
  6. Contact a Car Accident Attorney – An experienced attorney can help you explore your legal options and maximize your compensation.

Dealing with an uninsured driver can be overwhelming, but you don’t have to go through it alone. At Bison Law Firm, we fight for the rights of accident victims and help them recover the compensation they deserve.
